Terms of Service

1. Acceptance of Terms

By accessing or using the Zerocost platform, SDK, APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

Zerocost provides a monetization platform for software applications, including: (a) an SDK for integrating non-intrusive advertisements, (b) a Data Marketplace for anonymized usage data, (c) a self-serve advertising platform for sponsors, and (d) analytics and reporting tools.

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your API keys and credentials
  • Promptly update information if it changes
  • Accept responsibility for all activity under your account

4. Startup (Publisher) Terms

If you use our SDK to monetize your application:

  • You must ensure your application complies with all applicable laws
  • You must not artificially inflate impressions, clicks, or other metrics
  • You must display ads as delivered by our SDK without modification
  • Revenue is calculated based on verified impressions and clicks, minus any adjustments for invalid traffic
  • Startups can withdraw anytime through their payouts page

5. Partner (Advertiser) Terms

If you use our platform to run advertising campaigns:

  • All creative content must comply with our Advertising Guidelines
  • You are responsible for the accuracy of your ad content and landing pages
  • Budget commitments are binding once a campaign is activated
  • We reserve the right to reject or remove ads that violate our policies

6. Data Marketplace Terms

Data sold through the marketplace is anonymized and aggregated. Buyers may use purchased data for model training, analytics, and research purposes only. Buyers may not attempt to re-identify individuals from anonymized data. Sellers retain ownership of their raw data; Zerocost receives a commission on marketplace transactions.

7. Intellectual Property

Zerocost retains all rights to the platform, SDK, and documentation. You retain all rights to your application and content. By using our SDK, you grant us a limited license to serve advertisements within your application as configured by you.

8. Prohibited Conduct

  • Reverse engineering, decompiling, or disassembling the SDK
  • Using the Services for illegal purposes or to distribute malware
  • Interfering with the operation of the Services
  • Scraping or automated data extraction beyond API rate limits
  • Misrepresenting your identity or application metrics

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEROCOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO ZEROCOST IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the Services ceases immediately. We will process any outstanding payouts within 30 days of termination. Sections regarding intellectual property, limitation of liability, and dispute resolution survive termination.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.

12. End-User Data Rights

If you are an end-user of an application that integrates the Zerocost SDK:

  • You are not a party to the commercial agreement between the application developer and Zerocost.
  • You retain full rights to withdraw consent for data collection at any time through the in-app consent preferences panel.
  • Because data collected through our SDK is fully anonymized on your device before transmission, we do not store personal identifiers and are technically unable to isolate or delete specific individual data.
  • Revoking consent stops all future data collection from your session immediately.
  • Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.
